OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard.     (a) Jobsite - On or about October 21, 2014 employer did not conduct sufficiently frequent inspections of crane safety devices in that it failed to perform a daily crane load test before allowing employees to work from a man basket attached to the crane.

29 CFR 1910.23(d)(1)(iii): Flight(s) of stairs with 4 or more risers, less than 44 inches wide and having both sides open were not equipped with one standard stair railing on each side:     (a) Generator - On or about October 21, 2014 the 4 rung x 36 inch wide x 33 inch high stairway was missing the stair railing on the left side and the mid rail on the right side of the stairs.

29 CFR 1910.147(c)(3)(ii): In demonstrating that a level of safety is achieved in the tagout program which is equivalent to the level of safety obtained by using a lockout program, the employer shall demonstrate full compliance with all tagout-related provisions of this standard together with such additional elements as are necessary to provide the equivalent safety available from the use of a lockout device. Additional means to be considered as part of the demonstration of full employee protection shall include the implementation of additional safety measures such as the removal of an isolating circuit element, blocking of a controlling switch, opening of an extra disconnecting device, or the removal of a valve handle to reduce the likelihood of inadvertent energization.     (a) Control Tower Office - On or about October 21, 2014 a key switch was turned to the out of service position at the upstream left wall tainter valve control. The key was tagged but remained in the switch.

29 CFR 1910.180(d)(6): "Inspection records." Certification records which include the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the crane which was inspected shall be made monthly on critical items in use such as brakes, crane hooks, and ropes. This certification record shall be kept readily available.     Jobsite - On or about October 21, 2014 a monthly inspection of the Terex RT 230 crane was not completed.
