29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.          a)     On the site, the employer did not ensure that employees were provided and used fall protection when working from the second story outer plate area, hoisting materials to build the second story walls, at heights greater than six feet, thereby exposing employees to an approximate 14 foot fall hazard.

Note: When the top edge of a stairrail system also serves as a handrail, paragraph (c)(7) of this section applies.          a)     At the worksite, the employer did not ensure that the stairs used by employees to go from the first to second floor were equipped with at least one stair rail system along each unprotected side and/or edge, thereby exposing employees to a potential trip/fall hazard.
