29 CFR 1910.132(a): Protective equipment, including personal protective equipment, was not used whenever it was necessary by reason of the hazard(s).  The employer does not ensure that the employees use personal protective equipment.  This violation was observed on or about October 27, 2014 and at times prior thereto where employees were exposed to chemical hazards without using personal protective equipment.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees use personal protective equipment whenever it is necessary by reason of the hazard(s).

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein.  The employer does not ensure that all chemicals in the workplace are labeled, tagged, or marked with the identity and hazard warning of those chemicals.  This violation occurred on or about October 27, 2014, in the Pre- Press Shop near the Plate Developer Machine where a chemical in a portable bottle was used without a label or markings as to the chemicals identity or hazard warnings.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all chemical containers in the workplace are labeled with the identity and appropriate hazard warnings of the chemicals therein.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information.  The employer does not provide the update training according with the revised Hazard Communication Standard. This violation occurred on or about October 27, 2014, and at times prior thereto, when employees in the facility were required to handle hazardous chemicals without being trained on how to identify the hazard associated to those chemicals according with the revised Hazard Communication Standard.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are trained on all hazards in their work area according with the revised Hazard Communication Standard.
