29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) Colorado Pipe and Plumbing at 21000 E 32nd Pl, Aurora, CO 80011: On or before October 24, 2014 the exposing employer did not ensure that daily inspections of a trench, that was approximately 6 feet wide, 6.5 feet deep, and 20 feet in length, and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that the competent person did not identify that the trench was benched greater than the 45 degree maximum allowable slope for type B soil or did not take prompt corrective action to eliminate the cave-in hazard. This condition exposed employees to a crushing hazard by trench wall cave-in.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, were not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: (a) Colorado Pipe and Plumbing at 21000 E 32nd Pl, Aurora, CO 80011: On or before October 24, 2014 the exposing employer did not ensure that each employee working inside a trench that was approximately 6 feet wide, 6.5 feet deep, and 25 feet in length was protected from cave-in, in that the trench was benched at an angle greater than the 45 degree maximum allowable slope for type B soil. This condition exposed employees to a crushing hazard by trench wall cave-in.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Colorado Pipe and Plumbing at 21000 E 32nd Pl, Aurora, CO 80011: On or before October 24, 2014 the exposing employer did not ensure that the spoil pile was at least two feet from the edge of the trench. Two employees worked in the trench that was approximately 6 feet wide, 6.5 feet deep, and 25 feet in length. This condition exposed the employees to the hazard of spoil pile material falling into the trench or causing the trench wall to collapse.
