29 CFR 1910.178(n)(7)(iii): On all grades the load and load engaging means was raised farther than necessary to clear the road surface: a) Loading Area Behind Warehouse - A Yale Veracitor VX50 Lift Truck carrying its load too high while traveling along a curved path tipped over and slid on its side. The truck operator's foot was seriously injured as it scraped along the asphalt surface during the accident. On or about October 24, 2014. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a Yale Veracitor VX50 Lift Truck: a) 22976 Sussex Avenue, Georgetown, DE - An employee who was not trained in accordance to the requirements of the OSHA Powered Industrial Truck Standard, 29 CFR 1910.178 was seriously injured while operating a Yale Veracitor VX50 Lift Truck. On or about October 24, 2015. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
