29 CFR 1926.1101(k)(3)(i): Before work in areas containing ACM and PACM is begun; employers shall identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section. a. On or about October 27, 2014, at the above addressed jobsite, employees were conducting cleanup work in an area containing Asbestos-Containing Material (ACM), thermal system insulation. The employer did not identify the presence, location, and quantity of ACM, thereby exposing employees to the hazards associated with asbestos.

29 CFR 1926.1101(k)(4): In addition to the above requirements, all employers who discover ACM and/or PACM on a worksite shall convey information concerning the presence, location and quantity of such newly discovered ACM and/or PACM to the owner and to other employers of employees working at the work site, within 24 hours of the discovery: a. On or about October 27, 2014, at the above addressed jobsite, employees were conducting cleanup work which uncovered Asbestos-Containing Material (ACM), thermal system insulation . The employer did not convey information concerning the presence, location, and quantity of thermal system insulation ACM to the owner of the building, thereby exposing employees to the hazards associated with asbestos.

Asbestos waste, scrap, debris, bags, containers, equipment, and contaminated clothing consigned for disposal shall be collected and disposed of in sealed, labeled, impermeable bags or other closed, labeled, impermeable containers except in roofing operations where the procedures specified in paragraph (g)(8)(ii) of this section apply. a. On or about October 27, 2014, at the above addressed jobsite, employees were conducting cleanup operations of Asbestos-Containing Material (ACM), thermal system insulation. The employer did not dispose of waste in sealed containers, thereby exposing employees to the hazards associated with asbestos.
