29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):      (a)Newmyer Contracting, Inc. at 1022 Humboldt St., Denver, CO 80218:  On and before October 27th, 2014, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were engaged in roofing and tuck pointing activities from the concrete gutter and adjacent flat roof of a residential home. Employees were exposed to fall hazard of approximately 30 feet and 34 feet as a result.

(b)Newmyer Contracting, Inc. at 1022 Humboldt St., Denver, CO 80218:  On and before October 27th, 2014 the controlling employer did not ensure their subcontractor employees were protected from injury, in that, employees engaged in disposal of materials via the debris chute and also receiving of new materials via the laddervator on the flat roof located on the north side of a residential home were exposed to falls of approximately 30 feet without the use of an adequate fall protection system.
