29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.    a) 4 Berkeley Avenue , north side and west end of the unit -  Employees were working approximately 27 feet above the ground, from a pump jack scaffold system with defects such as but not limited to: poles not braced at the top and bottom, on or about 10/27/14.    b) 4 Berkeley Avenue , west side and north corner of the unit - Employees were working approximately 27 feet above the ground, from a pump jack scaffold system with defects such as but not limited to: poles not braced at the top and bottom, on or about 10/27/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a) 4 Berkeley Avenue , north side and west end of the unit- Employees were working approximately 27 feet above the ground, did not have proper fall protection for all sides of the scaffold as required, on or about 10/27/14.    b)  4 Berkeley Avenue , west side and north corner of the unit- Employees were working approximately 27 feet above the ground, did not have proper fall protection for all sides of the scaffold as required, on or about 10/27/14.       NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) 4 Berkeley Avenue, north side and west end of the unit- Employees without proper training were working from  improperly setup aluminum pump jack scaffolds, on or about 10/27/14.    b) 4 Berkeley Avenue, west side and north corner of the unit- Employees without proper training were working from improperly setup aluminum pump jack scaffolds, on or about 10/27/14.      Certification  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
