29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On 10/20/2014, employees from Tuepker Brothers Construction, Ltd. were framing a roof of a commercial building located at 6280 Mid Rivers Mall Drive, Saint Peters, MO. An employee was cutting and handing material to two other employees on the framed roof above him. He was working beneath the employees who were using various hand tools. He was not protected by a helmet where there was a possible danger of head injury from impact.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. On 10/20/2014, employees from Tuepker Brothers Construction, Ltd. were framing a roof of a commercial building located at 6280 Mid Rivers Mall Drive, Saint Peters, MO. They were using a ladder improperly to access the roof. The ladder side rails were not extended to three feet beyond the landing surface or edge of the roof.
