29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 10/24/14 at an excavation project located at 7025 Ellicott Road, Orchard Park, New York; employees were in an excavation probing for unmarked pipes and structures. The location of the excavation where the employees were probing was approximately 6 to 7 feet deep and not protected from cave-ins. NO ABATEMENT CERTIFICATION REQUIRED
