29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection.  On or about October 30, 2014 and October 31, 2014  Location: 155 West 126th Street, NY NY, 4th floor east side of stairs.  Employees were utilizing a temporary electrical outlet box to energize portable power tools, that was not protected from ground fault electrical shorts, because the temporary wiring system was not protected by a ground fault circuit interrupter.

29 CFR 1926.405(j)(1)(ii): Fixtures, lampholders, rosettes, or receptacles were not securely supported:  On or about October 30, 2014  LOCATION: 155 West 126th Street, New York, NY, west stairway on fourth floor.  a). Employees were using a temporary 1900 type, 4 inch square electric outlet box to energize power tools. The 1900 box was not properly secured to a permanent location.

29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail system, safety net system, or personal fall arrest system.Note:  If a guardrail system was chosen to provide the fall protection, and a controlled access zone had already been established for leading edge work, the control line may be used in lieu of a guardrail along the edge that parallels the leading edge.  On or about October 30, 2014 and October 31, 2014  A). Employees were exposed to fall hazards in excess of 10 feet to the lower level because they were not protected from falling by means of Personal Fall Arrest System, Guardrails, Safety Nets or Controlled access zone.    B). Employees entering and exiting the job site were exposed to falls to the basement due to floor sheathing being removed exposing the floor joists and the basement below.

29 CFR 1926.1052(b)(1): Foot traffic was not prohibited on stairways where the treads and/or landings of pan stairs were to be filled in with concrete or other material at a later date and stairs were not temporarily fitted with wood or other solid material at least to the top edge of each pan.Temporary treads and landings used for pan stairs that were to be filled in with concrete or other solid material at a later date were worn below the level of the top edge of the pan.  On or about October 30, 2014 and October 31, 2014  Location: 155 West 126th Street, New York, NY every stair well throughout the project.  Employees were traversing throughout the project using stairwells and were exposed to trip and fall hazards because the stair landing pans were not filled in with a solid material and the material used to fill stair treads had been worn down below the top lip of the tread pan.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a handrail system along each unprotected side or edge:  On or about October 30, 2014, and again on October 31, 2014.  Location: 155 West 126th Street, New York, NY  a). Employees working on site traversed the west stairs from roof top to street level numerous times daily to complete their work.  Employees were exposed to fall hazards because the stair systems was not equipped with a handrail system along each unprotected side or edge of the stairs.

Location; 155 West 126th Street, New York, NY West structure fourth floor stairway.  a). Employees utilizing stairs to traverse through the project from ground level to the roof, were not protected from falls off the stairs because the stairwells were not protected with midrails, screens, mesh, or intermediate vertical members.
