29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    a) Saw Shop:  The employer failed to provide audiometric testing to temporary employees exposed to noise above the Action Limit.  Employees were exposed to elevated noise levels while using the Trim Saw.  Employees working in the vicinity of the Trim Saw were exposed to continuous noise at 123.2% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 91.5 dBA during the 427 minute sampling period on November 12, 2014.  The exposure calculation included a zero increment for the 53 minutes not sampled.    b) Production Area: The employer failed to provide audiometric testing to temporary employees exposed to noise above the Action Limit.  Employees were exposed to elevated noise levels while using the Vertical Band Saw.  Employees working in the vicinity of the Vertical Band Saw were exposed to continuous noise at 67.36% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 87.1 dBA during the 437 minute sampling period on November 12, 2014. The exposure calculation included a zero increment for the 43 minutes not sampled.

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels:  Saw Shop and Production Area: The employer failed to provide annual audiometric testing to employees exposed to noise above the Action Limit.  Employees were exposed to elevated noise levels while in the process of making packaging for yard and garden products.  a) Employees working in the vicinity of the Rip Saw (Saw Shop) were exposed to continuous noise at 138.4% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 92.34 dBA during the 453 minute sampling period on November 12, 2014.  The exposure calculation included a zero increment for the 27 minutes not sampled.  b) Employees working in the vicinity of the Trim Saw (Saw Shop) were exposed to continuous noise at 123.2% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 91.5 dBA during the 427 minute sampling period on November 12, 2014.  The exposure calculation included a zero increment for the 53 minutes not sampled.   c) Employees working in the vicinity of the Top Frame Area (Production Area) were exposed to continuous noise at 86.39% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 88.9 dBA during the 445 minute sampling period on November 12, 2014.  The exposure calculation included a zero increment for the 35 minutes not sampled.  d) Employees were exposed to elevated noise levels while using the Vertical Band Saw (Production Area).  Employees working in the vicinity of the Vertical Band Saw were exposed to continuous noise at 67.36% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 87.1 dBA during the 437 minute sampling period on November 12, 2014.  The exposure calculation included a zero increment for the 43 minutes not sampled.

The employer did not institute a training program and ensure employee participation in the program:    Saw Shop and Production Area: The employer failed to provide training to employees exposed to noise above the Action Limit. 29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:    a) Production Area: Employees voluntarily using a Liberty Glove & Safety N95 filtering facepiece (Serial # TC-84-A-3714) were not provided a copy of Appendix D of the respirator standard.    The North American Container Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.134(c)(2)(i), which was contained in OSHA inspection number 312778392, citation number 2, item number 1 and was affirmed as a final order on August 17, 2010, with respect to a workplace located at 270 Johnson Lake Road, SE, Adairsville, Georgia 30103.      The North American Container Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.134(c)(2)(i), which was contained in OSHA inspection number 955406, citation number 2, item number 1 and was affirmed as a final order on May 16, 2014, with respect to a workplace located at 504 Corinth Road, Newnan, Georgia 30263.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) Production Area and Saw Shop: Employees were required to work with chemicals such as, but not limited to wood dust while manufacturing packaging for yard and garden products.  The employer did not provide training specific to the hazards of chemicals used at the establishment to all employees working with hazardous chemicals.    The North American Container Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(h)(1), which was contained in OSHA inspection number 955406, citation number 1, item number 4b and was affirmed as a final order on 5/16/14, with respect to a workplace located at 504 Corinth Road, Newnan, Georgia 30263.
