29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.   a) On October 30, 2014 and at times prior thereto; front of building; employees were not wearing eye protection while operating equipment such as but limited to saws exposing them to a struck by hazard while cutting brick.

29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights   a) On October 30, 2014 and at times prior thereto; front and south side of building, employees were observed on the working platform of a scaffold system that was not fully planked, missing two planks; the height from the work platform to ground level was 24 feet.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces are not to be used as a means of access.   a) October 30, 2014 and at times prior; front and south side of building, employees were exposed to a fall of approximately 24 feet when accessing the scaffold system by using the cross braces.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   a) On October 30, 2014 and at times prior thereto; front and side of building; employees working on a scaffold system installing the brick veneer and hoisting materials were exposed to a 24 foot fall at the ends of the working platform.
