29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The employer failed to provide documentation and certification for abatement of citation 1 item 1 in which a body belt was not worn and/or a lanyard was not attached to the bottom or basket when working from an aerial lift. Condition observed on or about 10/28/14.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated  a) 1861 Hooper Avenue, Toms River, NJ 08753: On or about October 28, 2014, employees working from the basket of a JLG 400S Telescopic Boom Lift were not protected from falls by the use of a fall restraint system. Employees were working approximately 15ft above the ground level.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
