Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while standing in between the forks of a loader: Jobsite - Workers were unloading 5 sheets of steel measuring 6 feet by 10 feet long by raising the forks of the front end loader (John Deere 304 H) an employee got in between the forks while standing the sheets upright when the load accidently shifted while raising the load and fell backwards onto employee severely injuring the worker.
