(a) Upper level near erected scaffold: On or about October 30, 2014 and at times prior thereto, the controlling employer, Wright Brothers Building Company, did not identify that the top rail to the guardrail system, being used to protect workers from an approximate 12 foot fall to concrete, was measured at 49 inches.
