Employees were working below the raised bucket of an excavator without the use of head protection.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) For employees working at the Southwest corner of Burnt Store Road and Cabana Road in Punta Gorda, as observed on or about October 31, 2014. Employees were in an unprotected excavation and the company identified competent persons did not remove the employee from the unprotected excavation after the condition was brought to their attention.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). a) For employees working at the Southwest corner of Burnt Store Road and Cabana Road in Punta Gorda, as observed on or about October 31, 2014. Employees were cutting water line pipe in an excavation that was not protected from cave-in. The excavation was approximately 6 feet 4 inches deep at the location of the employee.
