29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. The employer does not ensure that employees have a ladder, stairway, or ramp to access a scaffold. This violation occurred on or about November 3, 2014 when employees were exposed to an approximate 13 foot fall hazard while painting the roofline of the commercial structure from an elevated scaffold without adequate access. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees have proper access to the scaffold platform.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. The employer does not protect employees from falling when working on scaffold more than 10 feet above a lower level. This violation was observed on or about November 3, 2014, at the job site where employees were exposed to a fall hazard when working from a platform of frame scaffold at approximately 15 feet above the ground without being protected from falling to the ground. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees working from a scaffold 10 feet or more above a lower level are protected from falling.
