29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: a) Employees were exposed to the hazard of falling while climbing on an 8 foot A-Frame stepladder without its metal spreaders or locking devices in the open position. b) Employees were exposed to the hazard of falling while using an 8 foot A-Frame stepladder for access and egress between two points on the second story at the front elevation of the building. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIV ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Employees were exposed to the hazard of falling approximately two stories while working from attic deck surfaces and second story top plates without fall protection. AST Construction Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 315220111, citation 1, item 1, and was affirmed as a final order on February 17, 2011, with respect to a worksite located at 174 Beach, Glencoe, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
