29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) First floor/stairwell, new residential construction located at 1576 Roswell Street, Smyrna, GA 30080: Employees were exposed to falls of approximately 10-feet, 8-inches to the lower level while accessing a ladder which was not extended at least 3-feet past the second level.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   (a) Roof, new residential construction located at 1576 Roswell Street, Smyrna, GA 30080: Employee was exposed to eye injuries while operating a pneumatic Hitachi (Model NR83A-S1) Framing Nail Gun installing 1/2-inch OSB plywood sheathing without protective eyewear. Employee was exposed to struck-by hazards which included flying plastic debris and fasteners while operating this tool at 120 PSI in close proximity to the eyes and face.   Marcelo Torres was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number #314644451, citation number 1, item number 2 and was affirmed as a final order on 09/28/2011, with respect to a workplace located at 2632 Guinevere Trail (Lot #24) Douglasville, GA 30135.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Roof, new residential construction located at 1576 Roswell Street, Smyrna, GA 30080: Employee was exposed to fall hazards while installing 1/2-inch OSB plywood sheathing on a 7/12 pitched roof at eave heights of approximately 22-feet from the lower level without a fall protection system in place.   (b) Third level/attic, new residential construction located at 1576 Roswell Street, Smyrna, GA 30080: Two employees were exposed to falls hazards of approximately 21-feet, 3-inches to the lower level while engaged in framing activities with no guard rails or personal fall arrest systems used to prevent falls to the lower level.  Marcelo Torres was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314644451, citation number 1, item number 3 and was affirmed as a final order on 09/28/2011, with respect to a workplace located at 3632 Guinevere Trail (Lot #24), Douglasville, GA 30135.
