29 CFR 1910.141(a)(3)(ii): The floor of every workroom must be maintained, so far as practicable, in a dry condition. Where wet processes are used, drainage must be maintained and false floors, platforms, mats, or other dry standing places must be provided, where practicable, or appropriate waterproof footgear must be provided.  On November 3, 2014, the Employer failed to provide a safe and healthy work environment free of hazards associated with a dry working condition in the following areas:    (a) In the basement, whenever it rains or snows, floods with approximately 3 inches of standing water. The water comes in from the roof and through the roll up door causing mold to build up throughout the entire room. Employees were exposed to slip, trip, and fall hazards.  (b) In the furnace room, whenever it rains or snows, becomes inundated with water dripping down the electrical wires, lighting fixtures, and down the furnace causing mold to build up throughout the entire room. Employees were exposed to electrical hazards.   (c) Within the entire store; main floor, storage room, and extra parts rooms; there are numerous leaks that each time it rains or snows water drips on work spaces, parts, and products. Employees were exposed to slip, trip, and fall hazards along with electrical hazards in their immediate work spaces.

Sufficient access and working space must be provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment. The Employer failed to   (a) On November 3, 2014: Employees were exposed to potential hazardous condition of electrical shock and/or electrocution while working at the store due to two electrical panel boxes being blocked and not accessible in an event of emergency.

29 CFR 1910.303(g)(1)(v): Illumination must be provided for all working spaces about service equipment, switchboards, panelboards, and motor control centers installed indoors. Additional lighting fixtures are not required where the working space is illuminated by an adjacent light source. In electric equipment rooms, the illumination may not be controlled by automatic means only.  (a) On November 3, 2014: Employees were exposed to electrocution, slip, trip, and fall hazards approximately once per week when required to enter into the basement. The basement has one working light; employees are required to enter to place bait traps and/or to place archived files in the basement.

29 CFR 1910.305(j)(1)(iv): Fixtures installed in wet or damp locations must be identified for the purpose and must be so constructed or installed that water cannot enter or accumulate in wireways, lampholders, or other electrical parts.  (a) On November 3, 2014 entrance into the furnace room: Employees were exposed to electrical hazards. Electrical shock or electrocution due to constant leaks in the roof; resulting water causing wet or damp electrical parts throughout the furnace room. The leak was running down the light fixture in the furnace room. The leaking roof has caused the floor to rot through in the furnace room.     (b) On November 12, 2014 while headed to the store room: Employees were exposed to electrical hazards. Electrical shock or electrocution due to deep sink and mop bucket located within the vicinity of an electrical panel box; the electrical panel box was also left open.

(b) The Employer failed to conduct initial employee monitoring after an evaluation of asbestos was conducted and obtained positive asbestos results.

In addition, warning signs must be posted at all approaches to regulated areas so that an employee may read the signs and take necessary protective steps before entering the area.  (a) On November 12, 2014, bulk sampling conducted in the furnace room produced 3.0% Chrysotile in the brown tile. The air in the furnace room is recirculated throughout the entire store.   (b) The Employer failed to conduct initial employee monitoring after an evaluation of asbestos was conducted and obtained positive asbestos results. At no time since the results came back positive did the employer post any type of warning sign at the regulated areas so employees may read and take the necessary precautions when entering into that work area.

(a) On November 12, 2014, bulk sampling conducted in the furnace room produced 3.0% Chrysotile in the brown tile. The air in the furnace room is recirculated throughout the entire store.   (b) The Employer failed to conduct initial employee monitoring after an evaluation of asbestos was conducted and obtained positive asbestos results. After the positive results for ACM were determined, the employer failed to clean up the ACM and provide a safe and healthy work environment free of ACM waste and debris.
