29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: At this job site, an employee standing on the first tier platform of a two tier high scaffold was passing materials such as, but not limited to, buckets of mortar mix to employees on the second tier high platform. The employee was exposed to being struck on the head by the bucket in the event it slipped from the hands of the employee receiving the bucket on the second level platform. The employee worked on the ground and first tier level of the scaffolding area without a protective helmet (hard hat).

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation: At this job site employees worked from scaffold platforms two tiers high which did not have legs supported by base plates, mud sills or other adequate firm foundation. The scaffold used had mainly screw-jacks as support and on two scaffold pole the employer used cinderblock and a cut piece of 2x4 lumber in the absence of a screw-jack.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. At this job site, employees working, conducting brick laying from a two tier scaffold were not protected against a fall from the scaffold platform by guardrails or other fall protection methods.
