29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    A. J and M Miller Construction LLC worksite located at 2759 Longview Dr., Maumee, Ohio: On or about November 4, 2014, the employer did not ensure an employee was wearing proper eye protection while operating a pneumatic nail gun to secure sheets of plywood to a residential structure. The employee was exposed to potential flying object hazards while operating the pneumatic fastener.

29 CFR 1926.451(b)(2): Each scaffold platform and walkway was not at least 18 inches (46 cm) wide.     A. J and M Miller Construction LLC worksite located at 2759 Longview Dr., Maumee, Ohio: On or about November 4, 2014, the employer failed to ensure the dimensional 2 x 8 inch working platform in which an employee was working on was of sufficient width exposing the employee to a fall distance of approximately 9.00 feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     A. J and M Miller Construction LLC worksite located at 2759 Longview Dr., Maumee, Ohio: On or about November 4, 2014, the employer did not ensure employees were protected from falls while installing plywood sheathing on the roof of the two story residential structure. The employee was exposed to a fall distance of approximately 19.00 feet.  J and M Miller Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501 which was contained in OSHA inspection number 980011, citation number 1, item number 1and was affirmed as a final order on June 25, 2014, with respect to a workplace located at Sylvania, Ohio.
