Section 5(a)(1): The employer did not furnish a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing or struck-by injuries from collapsing storage racks: (a) On November 4, 2014, and dates prior to, for employees using or working near storage racks with damaged support columns located along the west wall of the storage area immediately west of the truck bay at the facility located at 2121 13th Street NE in Jamestown, North Dakota. (b) On November 4, 2014, and dates prior to, for employees using or working near a yellow storage rack with a damaged support column that was located in front of a truck bay overhead door in the storage area immediately west of the truck bay at the facility located at 2121 13th Street NE in Jamestown, North Dakota. (c) On November 4, 2014, and dates prior to, for employees using or working near the storage rack with grey columns and orange horizontal beams, where the horizontal storage beams were modified with a cutting torch, at the facility located at 2121 13th Street NE in Jamestown, North Dakota. Abatement note: Among other methods, one feasible and acceptable method to correct this hazard is to follow the guidelines described by the Rack Manufacturers Institute in ANSI MH16.2-1984. Specifically, section 3.11 which states that "As soon as damage occurs, the column twisted or distorted, the rack should be unloaded and the rack section removed and replaced with a new upright section" and section 3.2 which states that "The solution to improper beam installation is a periodic inspection of all beam connections, that the initial installation be verified to be consistent with the manufacturers instruction...".
