29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) Red Dock Building, employees accessing the top of the Rail Cars, were exposed to fall hazards of 13 feet. Guardrail platforms were 40 inches away from the railcars. b) White Dock Building, employee accessing the top of the Rail Cars, were exposed to fall hazards of 13 feet. Guardrail platforms were 24 inches away from the railcars.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): The employer did not complete the hazard assessment for the task of accessing the top of rail cars at the Red Dock and White Dock Buildings. These conditions exposed employees to the hazard of falling and necessitated the use of personal protective equipment.
