OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries from falling hazards and pinch points when employees are elevated on a platform when used with a powered industrial truck and the platform is not secured to the lifting carriage and/or forks and not provided with a means of mast protection and a standard guardrail.    (a)  Warehouse - On or about November 4, 2014, employees who were raised on an unsecured pallet on the forks of a Caterpillar Forklift were not protected by a standard guardrail or from coming into contact with the moving parts on the mast.        Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to implement the use of an approved personnel lifting platform as described in American National Standards Institute standard B56.1-1975, Article 513.
