29 CFR 1910.272(j)(1): Housekeeping. The employer shall develop and implement a written housekeeping program that establishes the frequency and method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces.  On or about November 6, 2014, the employer had not adequately developed and then implemented a housekeeping program. The employer's written program did not establish the frequency and the methods to reduce accumulations of combustible grain dust in that it did not establish:    a. Cleaning frequency and specific schedule for reducing accumulations of grain dust on ledges, floors, equipment, other exposed surfaces and for priority housekeeping areas. b. Methods used to remove grain dust and spills such as the use of non-sparking tools, brooms, brushes, use of compressed air (with equipment turned off as required by (j)(3)) and Class II rated vacuums.  c. Methods for the disposal of grain dust.

29 CFR 1910.305(b)(2)(i): All pull boxes, junction boxes, and fittings shall be provided with covers identified for the purpose. If metal covers are used, they shall be grounded. In completed installations, each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear.  a. On or about November 6, 2014, a pull box mounted on top of the electrical room in the Mill Feed building did not have the dust tight cover installed, or replaced following removal. This equipment is an ignition source for potential combustible grain dust fire and/or explosion in this hazardous location.   b. In the Old Set up Drymor room, the box located on the south wall had exposed live parts of 50 VAC or greater. Employees were exposed to an electrical contact hazard.

29 CFR 1910.307(c): Electrical installations. Equipment, wiring methods, and installations of equipment in hazardous (classified) locations shall be intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location.    On or about November 6, 2014, electrical equipment was not appropriate for the hazardous location(s) in the feed mill, such as but not limited to: a. the rectangular junction box/pull box mounted on the wall outside the control room near the pellet machine is not dust tight, b. a light fixture mounted on structural steel that is missing a component (cover) which allows direct contact with grain dust onto the light bulb, and   c. in the feed mill electrical room, electrical equipment including panels, boxes, a transformer and disconnects. Additionally a disconnect box was wired improperly and multiple control panels had removed covers/housings in this same location with open air access to live electrical components.

If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); and   a. On or about November 6, 2014, the employer had failed to provide Appendix D for employees as part of a respiratory protection program with voluntary respirator use only.
