29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Body shop- Employees wearing tight-fitting face piece type respirators (3M, 7182, half mask) voluntarily while sanding automobile parts had not received medical evaluations to determine their ability to safely wear the respirators. b) Paint area- An employee required to wear a tight-fitting face piece respirator (3M, 7193, half mask) while spray painting automobile parts had not received a medical evaluation to determine his ability to safely wear the respirator. The employer, MAACO, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(c)(1), which was contained in OSHA inspection number 977666, citation number 2, item number 1 and was affirmed as a final order on September 17, 2014, with respect to a workplace located at 8284 Tara Blvd., Jonesboro, GA. 30236.
