29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  a) 160 Morgan St., Jersey City, NJ - rooftop  The employer failed to submit the certification of corrective active worksheet along with required OSHA 300 and 300A forms referenced in Citation 2 Item 1 and required by the Stipulated Settlement Agreement which became a final order on August 17, 2015.  Violation occurred on or about 3/28/2016.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours.    a. 160 Morgan Street, Jersey City, NJ - Provost Square Development    a) On or about November 7, 2014 at approximately 0800 (EST) via telephone conversation a request was made to the employer to provide OSHA 300 and OSHA 300A forms or their equivalent.       b)  On or about November 7, 2014 at approximately 0857 (EST) an email request was made to the employer to provide OSHA 300 and OSHA 300A forms or their equivalent.     c) On or about December 23, 2014 at approximately 0917 (EST) an email request was made to the employer to provide OSHA 300 and OSHA 300A forms or their equivalent.    d) On or about December 31, 2014 at approximately 0749 (EST) an email request was made to the employer to provide OSHA 300 and OSHA 300A forms or their equivalent.    e) On or about January 14, 2015 at approximately 1000 (EST) a subpoena Duces Tecum was served to the employer to provide OSHA 300 and OSHA 300A forms or their equivalent.
