OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in-between hazards.  On or about November 5, 2014, adjacent to the airplane hanger at 782 Jasmine Rd., Crowley, LA. an employee was exposed to a crushing hazard when he was directed to unchain the connection between the bucket of a Link-Belt 210 X2 excavator and a frac tank.  At the same time as he stood between these two objects a manager approached the cab of the excavator to have a discussion with the operator.  The excavator was not de-energized or disabled.  As a result, when the operator in the cab stood up and accidentally made contact with the joystick controller the boom extended and crushed the employee between the bucket and frac tank.

29 CFR 1910.146(c)(5)(ii)(C): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i) but before an employee entered the space, the internal atmosphere was not tested with a calibrated direct-reading instrument.  On or about November 5, 2014, adjacent to the airport hanger located at 782 Jasmine Rd., Crowley, LA, the employer failed to conduct atmospheric testing before an employee entered into a frac tank to perform cleaning of drilling fluids.

29 CFR 1910.146(g)(4): The employer did not certify that the training required by 29 CFR 1910.146(g)(1) through 29 CFR 1910.146(g)(3) had been accomplished.  On or about November 5, 2014, at the work site located at 782 Jasmine Rd., Crowley, LA, the employer failed to certify the training of an employee (Plant operator) that had oversight for confined space activities (i.e. pre-entry metering, record of permit).

Unvaccinated employees performed first aid response rendering assistance where there was the potential presence of blood.
