29 CFR 1926.602(a)(3)(i): The employer moved construction equipment upon a grade that was not constructed and maintained to accommodate safely the movement of the equipment involved: (a) At the Iowa Army Ammunition Lake Mathes construction site, the employer did not assess and determine that the site would support the operation of heavy equipment such as the Case CX210 track hoe. The site was constructed of fill material such as but not limited to broken concrete, rebar, broken culvert, and earthen materials which contributed to an unstable footing.
