29 CFR 1926.652(g)(2): Additional requirement for shield systems used in trench excavations. Excavations of earth material to a level not greater than 2 feet (.61 m) below the bottom of a shield shall be permitted, but only if the shield is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the shield. a. At the construction site, located at Lot 51 Wintersweet Ln in Marysville, Ohio, employees used a trench shield that had approximately 5 feet below the trench shield that did not have cave-in protection.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. At the construction site, located at Lot 55 Weigela Ct. in Marysville, Ohio, employees were working in a trench that was approximately 6.5 feet deep, 2 feet wide and 20 feet long that did not have an adequately designed protective system thereby, exposing employees to a cave-in hazard. Beheler Excavating, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 984461, citation number 1, item number 3 and was affirmed as a final order on September 30, 2014, with respect to a workplace located at Avalon Place, Sunbury Road, Columbus 43219.
