29 CFR 1910.145(f)(5): Danger tags were not used where an immediate hazard presented a threat of death or serious injury to employees: A.) Texas Roadhouse Holdings, LLC, 7475 Peach Street, Erie, PA 16509, kitchen area, on or about November 1, 2014 and times prior thereto: Employees received burn injuries on multiple occasions when a filter basket from a Newco NKT3-NS1 tea brewing machine fell into the hot tea bin causing the hot liquid splash out and burn the employees. The burn accidents and associated injuries were caused by factors that included but were not limited to an improperly sized filter basket. The tea brewing machine was not removed from service after the accidents, tagged out of service and/or rendered safe through other equally effective methods such as moving the machine to a secure location to prevent its use.

Texas Roadhouse Holdings, LLC, 7475 Peach Street, Erie, PA 16509, manager's office, on or about November 7, 2014 and times prior thereto: Items including, but not limited to, a filing cabinet and a stool were stored within one-foot of the electrical circuit breaker panels. The blocked circuit breaker panel contained the main circuit breaker for the facility, main circuit breakers for the electrical panels including but not limited to, Panel A-E, and circuit breakers for equipment including, but not limited to, the dishwasher and roof-top units.
