29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The employer failed to provide documentation and certification for abatement of citation 1 item 1a in which employees were not protected by guardrail systems, safety net systems, or personal fall arrest system. Condition observed on or about 11/05/2014.  b) The employer failed to provide documentation and certification for abatement of citation 1 item 1b in which the employer did not provide a training program for each employee who was exposed to fall hazards. Condition on or about 11/05/14.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a) 159 N Academy St., Hightstown, NJ:  On or about 11/05/2014, four employees of VGR Construction were installing roof shingles on a two story residence.  The employees were not using fall protection and as such were exposed to a fall hazard of greater than 18 feet from the roof's eave to the ground below.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.  a) 159 N Academy St., Hightstown, NJ:  On or about 11/05/2014, four employees of VGR Construction were exposed to a fall hazard of greater than 18 feet while installing roof shingles on a two story residence.  The employees were not using fall protection.   The employer did not provide training to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards to the exposed employees.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
