OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where the employees were exposed to struck-by hazards:  On or about November 7, 2014 the employer did not protect employees from the recognized hazard of working under a suspended load of a forklift truck exposing employees to struck-by hazards.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use.  On or about November 7, 2014, employees were working from a work platform that was not specifically designed by the manufacturer exposing them to fall hazards.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.  On or about November 7, 2014, the employer did not protect employees from the recognized hazard of falling when employees worked from a work platform that was elevated by a Genie-844 tele-handler forklift approximately 24 feet from the ground below;  a) Employees were not wearing or using fall protection; and  b) Employees used the mid-railing of the work platform to achieve additional height.
