29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) On or about October 30, 2014, and at times prior, Kinnard's Painting, Inc. did not ensure that its employees were protected from fall hazards while painting a commercial building. Kinnard's Painting, Inc. did not ensure that its employees wore restraining devices such as body belts or harnesses with lanyards attached to the boom or basket of a Genie S-60X aerial lift, exposing employees to fall hazards in excess of 30 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a) On or about October 30, 2014, Kinnard's Painting, Inc. did not ensure that employees were protected from falls while working at heights greater than 6 feet. Employees of Kinnard's Painting, Inc. were exposed to fall hazards in excess of 16 feet while engaged in painting activities on the roof of a commercial building with no fall protection in place. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
