29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surfaces were not used as a means of access: a) On or about November 10, 2014, asbestos abatement employees were exposed to falls while they accessed work levels by climbing scaffold frames that were not designed for use as ladders or used a 6 foot portable ladder that was too short and not designed to take side-loading forces.

29 CFR 1926.1101(f)(2)(i): The employer failed to ensure that the exposure assessment was conducted in time to comply with requirements which are triggered by the exposure data or the lack of a negative exposure assessment: a) On or about November 10, 2014, and at times prior, the employer did not ensure that the exposure assessment was conducted in a timely manner to ensure that the powered air purifying respirators used by asbestos abatement employees were suitable for the exposure. Work began on November 4, 2014, but personal air samples that were collected were not analyzed until November 11, 2014.
