OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible dust fire hazards while working at or near an indoor fabric filter dust collector which returned filtered air directly back into the facility: a) On or about November 7, 2014, in the BMD department, the indoor DuroVac fabric filter dust collector, handling combustible processed corn flour, soy flour, and additive mixtures generated from upstream drying and blending processes exhausted back into the facility and lacked a means of fire protection. Among other methods, feasible methods to correct this hazard would be to follow the guidelines in the National Fire Protection Association (NFPA) Standard 654 "Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, 2013 ed." Sections 7.13.1.2.3 (fire protection) and 7.13.1.6 (exhaust air) and Standard 61 "Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities, 2013 ed." Section 10.4.12 (filtered air). Specifically, these methods may include, but are not limited to, the following: (1) Providing a spark/fire/ember detection and extinguishment/abort system upstream of the fabric filter dust collector and downstream of the spray drying and blending operations in accordance with Chapter 10 of NPFA 654 (2013); (2) Providing a spark/fire/ember detection and extinguishment system for the filter dust collector in accordance with Chapter 10 of NFPA 654 (2013); (3) Discharging exhaust air from the filter dust collector to an outdoor restricted area away from any building air intakes unless provisions are incorporated to prevent transmission of smoke, flame, combined products, flammable vapors, and heat from a fire in a dust collector back into the facility in accordance with Section 7.13.1.6.3 of NFPA 654 (2013) and Section 10.4.12.1 of NFPA 61 (2013).
