29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when: (b) The operator has been involved in an accident or near miss incident;    a. Dock Yard- On or about November 10, 2014, an employee involved  in an accident which led to an amputation involving the use of two forklifts was not retrained. The forklifts were being utilized to lift and dislodge a 53 foot long semi-trailer with landing gear down off the wheel housing of a truck cab, thereby exposing employees to struck-by and amputation hazard(s).

29 CFR 1910.178(m)(4): The employer shall prohibit arms or legs from being placed between the uprights of the mast or outside the running lines of the truck.    a. Dock Yard- On or about November 10, 2014, the employer did not ensure that employees did not place their arms or legs between the uprights of the mast or outside the running lines of the forklift truck. Employee was allowed to be underneath and in-between running lines of the truck. Thereby exposing employees to struck-by and amputation hazards.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    a. Dock Yard- On or about November 10, 2014, employees were required to operate a Powered Industrial Vehicle (forklift) that was missing a front headlight.
