OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by and crushing hazard from a collapsing wall: a) On November 7, 2014 and at times prior thereto employees performed interior wall framing activities next to a 24 foot high, 50 foot long, 2 hour fire separation wall. Bracing for the fire suppression wall was not properly positioned nor adequately maintained through-out the construction process. Note) Documentation and certification of corrective actions ARE required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by a guardrail system, safety net system, or personal fall arrest system: a) On November 7, 2014 and at times prior thereto employees performed framing activities on the first floor deck without a fall protection system in place. Employees were exposed to an 11 foot fall hazard to the ground below. Note) Certification of corrective action IS required for this item.
