29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, where employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response), or equivalently, a dose of 50 percent: a) PetsMart, Inc., Store 255 @ 62 Brentwood Promenade Court, Brentwood, MO 63144: On and before November 24, 2014, an employee in the Grooming Salon, a bather, was exposed to continuous noise levels at 65.9% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 65.9% is approximately 86.9 dBA. The sampling was performed for 435 minutes. The employer did not administer a hearing conservation program for the exposed employee. PetsMart, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard (29 CFR 1910.95(c)(1)) which was contained in OSHA Inspection 897838, citation number 1, item number 1, issued on April 26, 2013, with respect to a workplace located at 5812 Youngstown-Warren Road, Niles, OH 44446.
