29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   a) At the jobsite: 1236 Harmony Street - Employees performing bricklaying operations from the 4th level of the fabricated frame scaffold were exposed to fall hazards of approximately thirty-five (35) feet without the use of personal fall arrest systems or guardrail systems.  Observed on or about 11/12/2014.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   a) At the jobsite: 1236 Harmony Street - Employees were not provided with a safe means of access and/or egress to a fabricated frame scaffold platform, exposing employees to a fall hazard of approximately thirty-five (35) feet.  Employees were using the side frame of the scaffold to access and/or egress the working levels.  Observed on or about 11/12/2014.

29 CFR 1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6):   a) At the jobsite: 1236 Harmony Street - Employees performing bricklaying operations from a fabricated frame scaffold that was approximately one (1) foot away from a 230 volts service power line were exposed to shock/electrical hazards. The fabricated frame scaffold was erected around the power line. Observed on or about 11/12/2014.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:   a) At the jobsite: 1236 Harmony Street - Employees laying brick were exposed to a collapse hazard as the fabricated frame scaffold did not bear on base plates.  Two poles of the scaffold were supported on wood and cinder blocks while the other poles were supported with base plates. Observed on or about 11/12/2014.
