29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. (a) On November 12, 2014 during temporary employee interviews, it is stated that temporary employees are being allowed to utilize powered industrial trucks without being properly trained or certification of proper training. This lack of training could cause serious physical harm and injury to employees up to and including death.

29 CFR 1917.112(a)(1): Vehicle curbs, bull rails, or other effective barriers at least six inches (15.24 cm) in height shall be provided at the waterside edges of aprons and bulkheads, except where vehicles are prohibited. Curbs or bull rails installed after October 3, 1983, shall be at least 10 inches (25.4 cm) in height. (a) On or about Wednesday, November 12, 2014, at the edge of the dock where CTLC excavator works loading and unloading the barge, there is no bull rail or vehicle curb to prevent the excavator from continuing into the water in the event of a tip over, which creates a hazard that could cause serious physical injury up to and including death by drowning.
