29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer does not protect employees in an excavation from cave-ins. This violation occurred on or about November 13, 2014, at or near the intersection of Black Birch Lane and Bitternut Hickory in Tomball, TX where employees were exposed to a cave-in hazard when working in a 9 foot deep excavation without an adequate protective system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees who work in excavations are adequately protective from cave-ins.

This violation occurred on or about November 13, 2014, where employees were working in an unprotected excavation without being instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee is instructed in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury.
