29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On November 12, 2014, employees were exposed to the hazards associated with operating a powered industrial vehicle, while using a skid steer with forks attached to move construction material, and the employer did not ensure that each operator was competent to operate a powered industrial vehicle. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about November 12, 2014, employees laying bricks were exposed to the hazards associated with silica and Portland cement, while performing these work activities and the employer did not provide training to employees on hazardous chemicals, labeling, and safety data sheets. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
