29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: a) JEB Little Creek, 1350 Gator Blvd, Building 3601, Virginia Beach, VA 23459: On or about November 14, 2014, an employee who sprayed Portland cement with water to make mortar, was not required to wear appropriate personal protective equipment, such as goggles, as referenced by 1926.102, exposing the employee to potential eye injury. No abatement certification or documentation required.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a) JEB Little Creek, 1350 Gator Blvd, Building 3601, Virginia Beach, VA 23459: On or about November 14, 2014, employees who worked with hazardous chemicals such as, but not limited to Portland cement, were not provided with training on the minimum required topics of the revised Hazard Communication Standard, such as but not limited to, labeling elements and the standardized format for Safety Data Sheets, exposing employees to potential chemical injury or illness. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
