OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation and struck by hazards: a. On or about November 18, 2014, on the north side of the plant, employees were using hydraulic press brakes that were not guarded in the rear while the machine's drive motor was running, exposing employees to amputation and struck-by hazards.

On or about November 18, 2014, on the north side of the plant, an employee was using a hydraulic press brake that was not guarded to keep the operator's body and hands away from the point of operation, exposing employees to cuts, bruises, and amputations.
