OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to death or serious physical harm to employees in that employees were exposed to:  crushed-by and struck-by hazards caused by being within the danger zone of a raised tilt deck of a hydraulic tilt shed trailer while unloading unsecured wooden structures such as but not limited to sheds, garages, playhouses, gazebos and animal structures.     a) Retail Lot, 12 Fitzpatrick Road, Jefferson Township, PA - On or about November 17, 2014, an employee was unloading an unsecured wooden structure (playhouse) while standing at the back of a hydraulic tilt shed trailer when the unsecured wooden structure fell, crushing the employee.     In accordance with 29 CFR 1903.19(c) and (d), abatement certification and documentation is required for this violation.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a) Workplace:  Employees were operating a Mule IV forklift to transport prefabricated wooden sheds and did not receive formal instruction, practical training, and an evaluation of their ability to safely operate the equipment, exposing employees to struck-by and crushed-by hazards associated with forklift operations, on or about November 14, 2014.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation.

29 CFR 1904.39(a): The employer did not orally report the death of an employee because of a work-related incident.    a) Front Lot, 12 Fitzpatrick Road, Jefferson Township, PA - On or about November 17, 2014, the employer failed to report a work-related fatality within 8 hours of the incident.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation.
