29 CFR 1910.22(b)(1): Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repairs, with no obstruction across or in aisles that could create a hazard.  a.  At the work site, the warehouse concrete floor by the loading dock bays had damaged, missing and loose coating on the concrete floor that was a tripping hazard for employees who moved products with hand jacks and fork lifts. The employer had not ensured the floor had been kept in good repair.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  a.  At the work site located at 40 Cypress Street, Reynoldsburg, Ohio, employees operated a fork lift to unload delivered products, store the products in the freezer and cooler, and load trucks for delivery to customers on various routes.  The employer did not ensure that employees who operated the fork lift trucks had been evaluated every three years after their initial training.
