29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  a)  Employer did not conduct adequate safety inspections prior to employees working in an approximately 14.5 ft. L x 10.5 ft. w x 7.5 ft. D excavation.  Complete soil testing and classification was not conducted, spoil piles were not set-back at least two (2) feet from the wall, and required cave-in protection was not utilized.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):  a)  On 11-18-14, employees were working in an approximately 14.5 ft. L x 10.5 ft. W x 7.5 ft. D excavation without adequate cave-in protection.  The employer had constructed excavation walls at an approximate 45 deg. angle and not the required 34 deg. angle based on Type C soil.
